1. Acceptance of Terms
By installing, accessing, or using the Ecomdev Sections Hub application ("the App") or visiting our website, you agree to be bound by these Terms of Service. If you do not agree, please do not use our services. These terms constitute a legally binding agreement between you and Sabai Innovations Pvt Ltd.
2. Description of Service
Ecomdev Sections Hub provides a Shopify application that allows merchants to:
- •Browse and import pre-built theme sections into their Shopify stores
- •Access a library of landing page, pop-up, and theme section designs
- •Customize imported sections through the Shopify theme editor
- •Use editor tools, templates, and code snippets for section customization
- •Manage imported sections across multiple store themes
3. Account Registration
To use the App, you must have an active Shopify store and authorize the App through Shopify's OAuth process. You are responsible for maintaining the security of your Shopify account and for all activities that occur under your account. You must provide accurate information during the authorization process.
4. User Obligations
When using the App, you agree to:
- •Use the App only for lawful purposes and in compliance with Shopify's Terms of Service
- •Not reverse-engineer, decompile, or attempt to extract the source code of any sections
- •Not redistribute, resell, or share imported sections with third parties
- •Not use the App in a way that could harm, disable, or impair our services
- •Not attempt to gain unauthorized access to any part of our systems
5. Payment Terms
Pricing Plans
We offer the following plans: Individual Sections (free base, pay per section), Basic Plan ($2.99/month), and Advanced Plan ($4.99/month). All prices are in USD and may be subject to applicable taxes.
Billing
All billing is handled through Shopify Billing. By subscribing to a paid plan, you authorize Shopify to charge your payment method on a recurring basis.
Cancellation
You may cancel your subscription at any time through the Shopify admin. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.
Section Ownership
Once a section is imported into your theme, it becomes part of your theme files. Imported sections remain in your theme even after uninstalling the App or canceling your subscription.
6. Intellectual Property
All section designs, code, templates, and related materials are owned by Sabai Innovations Pvt Ltd and are protected by intellectual property laws. Upon purchase or subscription, we grant you a non-exclusive, non-transferable license to use the sections in your Shopify store(s). You retain all rights to your own content and customizations made to the sections.
7. Limitation of Liability
To the maximum extent permitted by law, Sabai Innovations Pvt Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the App. Our total liability shall not exceed the amounts you have paid to us in the twelve (12) months preceding the claim.
8. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free from viruses or other harmful components.
9. Service Availability and Modifications
We reserve the right to modify, suspend, or discontinue any part of the App at any time, including adding or removing sections from the library, updating features, and changing pricing. We will provide reasonable notice of material changes through our website or email.
10. Termination
We may terminate or suspend your access to the App at any time for violation of these terms or for any other reason at our discretion. Upon termination, your right to use the App ceases immediately, but any sections already imported into your theme will remain functional.
11. Indemnification
You agree to indemnify and hold harmless Sabai Innovations Pvt Ltd, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App, violation of these terms, or infringement of any third party's rights.
12. Changes to Terms
We may update these Terms of Service from time to time. We will provide at least 30 days' notice of material changes by posting the updated terms on our website. Your continued use of the App after the effective date of the updated terms constitutes acceptance of the changes.
13. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of India. Any disputes arising from these terms shall be resolved through binding arbitration in Jaipur, Rajasthan, India.
